GENERAL INFORMATION AND ENLIGHTENMENT TEXT

This Enlightenment Text has been prepared by HERA EĞLENCE VE MİMARİ AYDINLATMA SİSTEMLERİ İÇ VE DIŞ TİC. A.Ş. / MERSIS: 0461 0616 2110 0001 ("COMPANY" or "HERA LED") as the "DATA CONTROLLER" within the scope of the Article 10 of the Personal Data Protection Law ("PDPL") and the Procedures and Principles Regarding the Fulfillment of the Lighting Obligation.

The personal data transmitted to "HERA LED" is used only for the purposes of obtaining personal data, without being used for purposes other than its purpose, without processing personal data without explicit consent or the existence of any of the exceptional cases in Article 5 of the PDPL, not sharing personal data with third parties, and taking all necessary administrative and technical measures to ensure the appropriate level of security.

1. Within the Scope of Our Activities, What Personal Data is Processed and What are the Purposes of Processing Your Personal Data?

1.1. From the Related Individuals Applying for Employment:

  • Identity Information (Name/Surname, T.C. ID number, Date/Place of Birth, Marital Status, Nationality, ID/Driver's License),
  • Gender Information (Gender Information),
  • Contact Information (Phone number, Residence/Correspondence/Email Address),
  • Reference Information (Resume information, names declared as references on the application form),
  • Education Information (Copy of Diploma-Exit Certificate/E-Government Declaration, Foreign language knowledge/Courses attended, internships/courses/seminars, and certificates received, awards),
  • Professional Experience Information (Performance data resulting from ability tests applied during job interviews, courses attended, seminars, and certificates received, awards, places worked in the past),
  • Physical Space Security Information (Images recorded with camera recordings),
  • Visual and Auditory Records (Photograph submitted for the job application form/CV, information and documents submitted by the relevant person with their own consent),
  • Legal Transaction Information (Information containing personal data in correspondence with judicial authorities and in petitions and responses to be submitted to courts in a possible judicial process),
  • Health Data/Special Qualification Data (Health data submitted by the person with their own consent),
  • And Other (Driver's License Information, Military Service Status Information obtained through E-Government, Computer Usage Level Information, Used Computer Programs, Social Security Entry Declaration, Information on whether there is a smoking habit, Signature Information, Handwriting).

1.2. From Employees:

  • Identity information (Name/Surname, T.C. ID number, Date/Place of Birth, Marital Status, Nationality, ID/Driver's License/Passport Copy, Population Registry Certificate),
  • Contact Information (Residential Address Document, Residence Address, Home and mobile phone number),
  • Professional Information (Position name, department and unit, title, Labor Institution Registration Certificate, last employment start date, employment start and end dates, insurance entry, social security number, tax office number, Retirement Fund registration number, Bağkur registration number, working day count, projects worked, monthly total overtime information, seniority indemnity base date, seniority indemnity additional day, leave seniority base date, leave seniority additional day, leave group, exit/return date, day, reason for leave),
  • Financial Information (Financial and salary details, payrolls, premium entitlements, premium amounts, file and debt information related to execution proceedings, Bank Account Statement Copy),
  • Health Data (Blood Type Information, Occupational Disease, health report on whether there is a disability status, blood and other tests taken within the scope of the Periodic Examination Report, Hemogram, Glucose Test, Tetanus Vaccination Card, Vaccination Information, ECG, Disability Report, Chest X-ray, Respiratory Function Test, Audiometry test),
  • Physical Space Security Information (Camera records information),
  • Visual Records (Visual records within the scope of the introduction of business activities),
  • Conviction and Security Measures (Information about convictions and/or information about security measures),
  • Biometric Data (Facial recognition),
  • Legal Transaction Information (Information containing personal data in correspondence with judicial authorities and in petitions and responses to be submitted to courts in a possible judicial process),
  • Transaction Information (IP Address, Internet Site Entry-Exit Information, Password Information),
  • And Other (Driver's License Information, Military Service Information, Computer Usage Level Information, Information on whether there is a smoking habit, Signature Information, Handwriting).

1.3. From Customers:

  • Identity Information (Name, Surname, T.C. ID number of the authorized representative of Real/Legal Person),
  • Contact Information (Phone number, email address, address information to be shipped),
  • Financial Information (Tax ID number, bank account/IBAN number, invoice information),
  • Physical Space Security Information (Images recorded with camera recordings),
  • Visual and Auditory Records (Photographs and videos taken in the workplace/workplace-like areas for use in the promotion of the "COMPANY"),
  • Legal Transaction Information (Information containing personal data in correspondence with judicial authorities and in petitions and responses to be submitted to courts in a possible judicial process),
  • Transaction Information (IP Address, Internet Site Entry-Exit Information, Password Information),
  • Location Information (Location information for customers with user accounts),
  • Customer Transaction Information (Request information, Complaint information).

1.4. From Visitors:

  • Physical Space Security Information (Images recorded with camera recordings),
  • Legal Transaction Information (Information containing personal data in correspondence with judicial authorities and in petitions and responses to be submitted to courts in a possible judicial process),
  • And Other Information (Documents you have submitted with your consent),
  • Transaction Information (IP Address, Internet Site Entry-Exit Information, Password Information).

1.5. From Interns/Students:

  • Identity Information (Name, surname, T.C. ID number, Date of birth, Place of birth, Marital status),
  • Identity and Contact Information of the close relative (Name, phone number of mother and father, if the guardian is not present, name, surname, contact information of the close relative),
  • School Information of the Student (School name, department, number, start date of work),
  • Contact Information (Phone number, address information, email address),
  • Physical Space Security Information (Images recorded with camera recordings),
  • Gender Information,
  • Financial Information (IBAN number),
  • Visual and Auditory Records (Photographs and videos taken in the workplace/workplace-like areas for use in the promotion of the "COMPANY"),
  • Legal Transaction Information (Information containing personal data in correspondence with judicial authorities and in petitions and responses to be submitted to courts in a possible judicial process),
  • Transaction Information (Request information, Complaint information),
  • Transaction Information (IP Address, Internet Site Entry-Exit Information, Password Information),
  • Other (Name, surname of the school administrator, signature information),
  • Health Data (Health data submitted by the person with their own consent).

2. To Whom and for What Purpose Your Personal Data May Be Transferred

The personal data that has been categorized above and whose processing purposes have been specified can be transferred domestically and internationally within the scope of business activities; To representatives and proxies authorized by you (for the purpose of fulfilling business activities and fulfilling responsibilities arising from the law), to authorized public institutions and organizations (to fulfill our obligation to prove in a possible judicial process, to fulfill our obligations arising from laws and other legal regulations), Lawyers, Consultants, Banks, Financial Advisors, OSH / OHS Companies, Insurance Consultancy / Audit / Companies and Other Private Legal Entities (to fulfill the company's business activities and policies and fulfill responsibilities arising from the law), Storage, archiving, information technology support service provider companies located domestically and abroad (ERP, T&A, server, hosting, software, cloud, IT) can be transferred for the purposes of acquainting with the persons you have shown as references (verification).

3. Collection Method and Legal Basis of Your Personal Data

Your personal data is collected by "HERA LED" within the framework of the purposes listed above, through the method of filling out contract forms and information and documents provided to the data controller by you, automatically or non-automatically, in writing, verbally, or electronically. Your personal data is collected within the framework of the legal reasons specified in Articles 5 and 6 of the PDPL, such as the establishment or performance of the contract, the legitimate interests of "HERA LED" and the fulfillment of legal obligations, the establishment, use, or protection of a right, and the explicit consent of the data subject, if any.

4. Your Rights as the Personal Data Subject in Article 11 of the Law

As the data subject, in accordance with Article 11 of the PDPL; you have the right to learn whether your personal data is processed, request information if your personal data has been processed, learn the purpose of processing your personal data and whether they are used appropriately for their purpose, learn the third parties to whom your personal data is transferred domestically, request correction of your personal data if it is incomplete or incorrectly processed, and request notification of this correction to third parties to whom your personal data has been transferred, request deletion or destruction of your personal data in case the reasons requiring its processing cease to exist, and request notification of this deletion to third parties to whom your personal data has been transferred, object to a result against you arising from the analysis of processed data solely by automatic systems, and demand compensation if you suffer damage due to the processing of your personal data unlawfully.

You can access the Relevant Person Application Form on our website (www.heraled.com) and submit your requests related to the rights listed above by filling out this form or by sending a written document with the same content to "HERA LED." Depending on the nature of your request, your applications will be concluded free of charge as soon as possible and within a maximum of thirty days; however, if the process requires an additional cost, you may be charged a fee according to the tariff determined by the Personal Data Protection Board. "This Data Controller HERA EĞLENCE VE MİMARİ AYDINLATMA SİSTEMLERİ İÇ VE DIŞ TİC. A.Ş. (MERSIS: 0461061621100001)"COMPANY" may contain personal data in the categories of "Identity Information, Contact Information, Professional Experience Information, Customer Transaction Information, and Financial Information" either in the email content sent by the COMPANY or in the email content sent to the COMPANY by you. This Information Text has been prepared by HERA EĞLENCE VE MİMARİ AYDINLATMA SİSTEMLERİ İÇ VE DIŞ TİC.  (“COMPANY” or “HERA LED”) as the data controller within the scope of the Communique on Principles and Procedures to be Followed in Fulfillment of the Obligation to Enlighten under the Law on the Protection of Personal Data No. 6698 (“KVKK”) Article 10.

Video recordings are made within our service buildings through security cameras located at the entrance doors, exterior of the building, dining hall, production/work areas, warehouse, and office floors to ensure the security of the building/workplace. The recording processes are monitored by the secretary and audited by the General Manager and the Manager of Financial and Administrative Affairs along with the department responsible.

In accordance with Article 5 of the Law on the Protection of Personal Data No. 6698, which states the legal obligation of the data controller to fulfill, and the legal basis of "it is mandatory for the data controller to process data for the fulfillment of its legal obligation" and "it is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject," these personal data are processed automatically. These personal data may be transferred to judicial authorities or relevant law enforcement agencies in accordance with legal requirements or in case of disputes related to legal obligations.

As a data subject in accordance with Article 11 of the Law, you have the right to learn whether your personal data is processed, to request information if your personal data has been processed, to learn the purpose of processing your personal data and whether it is used in accordance with its purpose, to know the third parties to whom your personal data is transferred within the country, to request correction of your personal data in case of incomplete or incorrect processing, and to request the deletion or destruction of your personal data within the framework of the conditions stipulated by law, even if they have been processed in accordance with the law, and to request that these transactions be notified to third parties to whom your personal data have been transferred. If automated systems result in a conclusion against you by analyzing the processed data exclusively through automatic systems, you have the right to object to this.

For your applications regarding the rights listed in Article 11 of the KVKK, you can fill out the Relevant Person Application Form, which you can access on our website (www.heraled.com), or you can send it to "HERA LED" with another written document with the same content. Depending on the nature of your request, your applications will be concluded as soon as possible and at the latest within thirty days; however, if the transaction requires an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
